That didn't come across clearly to me, at least from the link PeterE posted. I got the impression both vehicles were in the same lane throughout the incident.

As for the question of following distance, while I understand the point that one should not follow so close that one can't avoid hitting someone who stops suddenly in front, I don't think that point in itself argues that people should be allowed to brake to a near standstill in flowing motorway traffic with impunity. Being able to argue that the motorcyclist was at fault is not the same as being able to argue that the driver was faultless.
